These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," "User") and Blossom Gratitude ("we," "us," "our") governing your use of the Blossom Gratitude mobile application (the "App") and all related services.
By creating an account, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

The App uses artificial intelligence (AI) technologies, including large language models, image generation models, and text-to-speech systems, to create daily content.
You must be at least 16 years of age to create an account and use the App. By using the App, you represent and warrant that you are at least 16 years old. If you are between 16 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We reserve the right to request proof of age and to terminate accounts that we reasonably believe belong to users under 16.

New users receive a 7-day free trial that begins upon account creation. During the trial, you have full access to all App features. No payment information is required to start the trial. After the trial expires, continued access to premium features requires an active subscription.
The App offers a monthly subscription ("Pro") that provides access to all features, including daily video generation, voice input, guided meditation, and daily gifts. Subscription pricing is displayed in the App and may vary by region, platform, and currency.
All payments are processed through the Apple App Store (for iOS) or Google Play Store (for Android). By subscribing, you agree to the payment terms of the respective platform. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
You may cancel your subscription at any time through the Apple App Store or Google Play Store settings. Upon cancellation:
Refund requests must be directed to Apple or Google, as they process all payments. We do not have access to your payment information and cannot process refunds directly. Apple and Google handle refunds per their respective policies.
We may change subscription pricing at any time. Existing subscribers will be notified in advance per Apple's and Google's policies. Continued use after a price change constitutes acceptance. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.
You agree to use the App only for its intended purpose as a personal gratitude and wellbeing practice. You agree not to:
Violation of these terms may result in immediate suspension or termination of your account without notice.
The App uses artificial intelligence to generate daily gratitude videos, including written scripts, visual imagery, and voice narration. This content is generated by machine learning models and is not created, reviewed, or endorsed by human professionals (including but not limited to psychologists, therapists, counselors, medical professionals, or spiritual advisors).
AI-generated content may contain inaccuracies, errors, or statements that are inappropriate, nonsensical, or culturally insensitive. While we make reasonable efforts to curate high-quality prompts and topics, we cannot guarantee the accuracy, appropriateness, completeness, or reliability of any AI-generated content.
The inclusion of quotes, names, topics, or references in AI-generated content does not constitute our endorsement of, or affiliation with, any quoted individuals, organizations, philosophies, or belief systems. Quotes and attributions generated by AI may be inaccurate or fabricated.
AI-generated content delivered through the App is provided for your personal, non-commercial use only. You may not reproduce, distribute, publicly display, sell, license, or create derivative works from AI-generated content without our prior written consent.
You retain ownership of all content you create through the App, including gratitude text entries and voice recordings ("User Content"). We do not claim ownership over your User Content.
By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, store, and transmit your User Content solely for the purpose of providing and improving the App's services (e.g., transcribing voice recordings, storing journal entries). We will not use your User Content for advertising, marketing, training AI models, or any purpose unrelated to delivering the service to you.
Voice recordings are transmitted to our servers for transcription processing. Recordings are deleted immediately after transcription and are not stored, archived, or used for any other purpose. The transcription service (OpenAI Whisper) may retain the audio temporarily per their data processing policies (up to 30 days for abuse monitoring).
You are solely responsible for the content of your gratitude entries. We do not monitor, review, or moderate User Content.
The App is a general wellness and personal development tool. It is NOT:
Use of the App does not create a patient-provider relationship, therapist-client relationship, or any other professional care relationship between you and Blossom Gratitude, its employees, or its affiliates. No content in the App should be interpreted as professional health advice.
While gratitude practices have been associated with positive psychological outcomes in published research, individual results vary significantly. You acknowledge and understand that:

The App is not equipped to detect, respond to, or manage crisis situations.
You use the App at your own risk. You acknowledge that you are solely responsible for your mental and emotional wellbeing, and that your use of the App is a personal choice. You agree to discontinue use if you experience any adverse psychological effects and to seek professional help if needed.
The App, including its design, code, branding, curated content, topic library, music, and all related materials, is owned by Blossom Gratitude and protected by copyright, trademark, and other intellectual property laws. AI-generated content is produced using our proprietary prompts and curation systems.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the App, you acknowledge that you have read and understood the Privacy Policy.
We strive to make the App available at all times, but we do not guarantee uninterrupted or error-free operation. The App requires an internet connection for most features, including video generation, voice transcription, and data synchronization. The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.
Daily video content is generated automatically and made available each day. Video segments and related assets are automatically deleted after 3 days. We do not guarantee that specific past content will remain accessible.
We reserve the right to modify, update, suspend, or discontinue any part of the App at any time, with or without notice. This includes changes to features, content, pricing, and supported platforms. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
You may stop using the App and delete your account at any time. To request account deletion, contact us at privacy@blossomgratitude.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Active subscriptions must be cancelled separately through Apple or Google.
We may suspend or terminate your account at any time if you violate these Terms, if we are required to do so by law, or if we discontinue the App. Where possible, we will provide notice before termination. In the event of termination for violation of these Terms, no refund will be provided for any remaining subscription period.
Upon termination, your right to use the App ceases immediately. Sections 7.1 (User Content ownership), 8 (Health Disclaimer), 13 (Limitation of Liability), 14 (Indemnification), and 16 (Governing Law) survive termination.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT:

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY EUROS (EUR 50), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be lawfully excluded or limited.
You agree to indemnify, defend, and hold harmless Blossom Gratitude and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
Before filing any formal legal action, you agree to first contact us at legal@blossomgratitude.com and attempt to resolve the dispute informally for at least 30 days.
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law principles. Any disputes arising from or relating to these Terms or your use of the App that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the competent courts of the Netherlands.
If you are a consumer in the European Union, you are entitled to the protection of the mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Blossom Gratitude regarding your use of the App, superseding any prior agreements.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall only be effective if made in writing and signed by us.
You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, internet or infrastructure failures, or third-party service outages.
These Terms do not create any third-party beneficiary rights. Apple, Google, and other third-party service providers are not parties to these Terms and bear no responsibility for the App or its content.
We may revise these Terms from time to time. When we make material changes, we will:
Your continued use of the App after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the App.
